Third-Party Links and Hosted Apps

The Platform serves as a gateway to apps cataloged by Ofuju. Apps listed in the Ofuju catalog are hosted on third-party app stores, most notably Google Play. Ofuju does not host, maintain, certify, or control the apps themselves, nor does it guarantee their availability, functionality, safety, or quality. Access to or use of any such app is governed by the terms of the applicable app store and the developer’s policies. By clicking through to Google Play or other stores, you acknowledge and agree that Ofuju bears no responsibility for the Apps or their content, and that your use thereof is at your own risk.

Disclaimer of Warranties

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE.” OFUJU AND ITS LICENSORS DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR RELIABILITY. OFUJU DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. CONTENT YOU ACCESS OR DOWNLOAD THROUGH THE PLATFORM IS AT YOUR OWN RISK.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL OFUJU, ITS AFFILIATES, OR ITS LICENSORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM OR ANY CONTENT OBTAINED THROUGH IT. THE AGGREGATE LIABILITY OF OFUJU AND ITS LICENSORS FOR ACTUAL DAMAGES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS PAID, IF ANY, BY YOU TO OFUJU IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) USD 100. THIS LIMITATION OF LIABILITY APPLIES TO ALL CLAIMS OF LIABILITY, REGARDLESS OF THE FORM OF ACTION, AND WHETHER OR NOT OFUJU HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Indemnification

You agree to defend, indemnify, and hold harmless Ofuju, its affiliates, officers, employees, and licensors from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses arising from your use of the Platform, violation of these Terms, or infringement of any third-party rights.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms shall be resolved in the state or federal courts located in Wilmington, Delaware, or by such alternative dispute resolution as may be mutually agreed upon by the parties.

Termination

We may suspend or terminate your access to the Platform at our sole discretion for any reason, including violation of these Terms. Upon termination, your right to use the Platform ceases immediately and you must cease all use of the Platform.

Privacy

Our Privacy Policy, available on the Site, describes how we collect, use, and disclose information about you. By using the Platform, you consent to the terms of the Privacy Policy, which is incorporated into these Terms by reference.
